New York State Assemblyman, Democrat Brian Kavanagh introduced the “Gun Violence Restraining Act” legislation. In effect, what this out of touch with reality Legislator is proposing is if anyone does not feel safe around someone else, for what ever reason, they can invoke this law, which will dispatch police to that person’s home and confiscate their legally owned firearms. Without so much as committing a crime, being a suspect of a crime, being affiliated to a crime, or having any criminal history what so ever, will be denied several of the articles in the Bill of Rights.
The complainant can report the suspect said something disconcerting; hence attacking 1st amendment free speech. At which time their private property, namely legally owned firearms can be confiscated from their home; violating their 2nd and 4th amendment rights. Then, they would be subject to obtain a psychiatric evaluation to prove they are not mentally ill and a danger to themselves or the public; violating their 5th Amendment rights.
Ponder then, the plethora of good intentions gone wrong that could potentially happen as well; ranging from concern over depression, sadness, despondency, mood swings, or just simply having a bad day, may lead to you getting taken in for mental evaluation and your private property seized.
Assemblyman Kavanagh tried to justify this sneaky legislation as a tool for families to help prevent suicides or rampage killing by a family member, who they suspect as suicidal or a potential mass murderer. His assessment is without any basis in reality or truth. Assemblyman Kavanagh is a well-known prolific author of redundant anti – private gun ownership legislation, that are in varying steps of the legislative process.
This stinks of more Albany politics of hysteria. Bad laws born of prejudice and mid-wifed by hysterics, take decades to undo. This kind of proposed legislation, ultimately engender public fear and suspicion between friends, families, neighbors and co-workers. It seems he is personally hell-bent on dis-arming the legal gun owners by twisting any fact, omitting any truth, sneaking any piece of legislation, and using any Tammany Hall lawyers trick, that would in the final analysis, nullify the Bill of Rights to satisfy his own, warped view that Americans, disarmed by the power of their own government, will unshackle that government and permit them to shred the document they seethe to loathe.
The “feel safe” by disarming responsible gun – owners mentality is an arrogant and pretentious abuse of power by another typically self-important, career pencil pusher, that figures himself to be smarter than George Mason, Benjamin Franklin, Thomas Jefferson, Patrick Henry and George Washington, all rolled together. Those like him believe they can improve on the accomplishments of men, who achieved them through innumerable great deeds, copious amounts of American patriot blood, incalculable sacrifice, personal peril to life, treasure and sacred honor.
Setting aside their contempt for the Bill of Rights and the accomplishments by statesmen more than such as Assemblyman Kavanagh; consider the insidious danger they pose by such a covert attack at the very heart of our national liberty. The right to free speech, even to offend some is a small price to pay. The right to keep and bear arms, even at risk of the lunatic; is a small price to pay for our personal liberty. The right to be secure in our homes, our papers, our private property, even at the risk of harboring the criminal; is a small price to pay for our own privacy.
The pernicious nature of such legislation is born from the mind of legislators, who see themselves as our rulers, over-seers, and task masters, not our public employees. Assemblyman Kavanagh has been trying to advance a fascistic rulership over New Yorker’s under the guise of beneficence hidden in every piece of legislation that would nullify the spirit, if not the word, enshrined in the Bill of Rights.
Mayor Fiorello La Guardia, on his first day in office, dispatched his Commissioner of Police and arrested the gangster Charlie “lucky” Luciano. He did it as a matter of justice against a criminal. Assemblyman Kavanagh and those who think like him, propose to strip you and I of the prudent and formidable protections the Bill of Rights offer, and treat us, free American citizens, as if we are the criminals to be arrested, if only to satiate their insatiable lust for power and rulership over free people. The only way to rule over free people is to strip them of their freedoms and deny them the weapons that ensure it.
They aim to render us dependent, to make us feel more contempt for our freedom than for their power to rule us. They look to turn neighbor against neighbor, wife against husband, civilian against veteran, us against each other; and not free people restraining their government, as our founders intended.
Reject this contemptible attempt to yet again nullify that which so many bled and died to guarantee. Look to history. No government ever disarmed their own population to free them nor protect them.
Assemblyman Kavanagh has violated his oath to preserve, protect and defend the U.S. Constitution, from all enemies, foreign and domestic because he actively seeks to shred that document in the name of progressivism. New York is not California. Fascism, be it incrementally bundling the concentration of power away from the citizen to the Courts, or the governing body, in any form or fashion anti-theoretical to the Bill of Rights, should not hold a seat in Albany or Washington.
